We need to talk about what happens when the gavel falls, the cell door closes, or the courtroom empties. Because for trans people—particularly trans women of color—the scales of justice are not balanced. They are tipped so far in the wrong direction that justice, in its truest sense, has been taken entirely. Even when trans people are the plaintiffs or petitioners—seeking name changes, custody of their children, or protection from discrimination—they are frequently subjected to invasive questioning, misgendering by judges, and the requirement to "prove" their authenticity in ways cisgender people never are. When the arbiter of law refuses to acknowledge a person’s basic humanity, justice is not delayed. It is taken.
